When a child is born to married parents, the state of California assumes these two individuals are the child’s parents. When a child is born to unmarried parents, parentage needs to be legally established before other family law issues can be decided. An unwed couple may establish paternity voluntarily by each party signing a Declaration of Paternity. Or, the matter may be settled by the court.
